Form 3 - Notice seeking possession of a property let on an Assured Tenancy or an Assured Agricultural Occupancy

Housing Act 1988 section 8 as amended by section 151 of the Housing Act 1996. This is the prescribed form for England (Form 3).

Your landlord intends to apply to the court for an order requiring you to give up possession of .

3. GROUNDS FOR POSSESSION

Possession is sought on the ground(s) set out below. The full text of each ground follows.

4. Ground 1 - Landlord's own home

The landlord (or a joint landlord) previously occupied the dwelling as their only or principal home, or requires it as the only or principal home for themselves or their spouse or civil partner, and notice of this ground was given before the tenancy began (or the court dispenses with that notice).

5. Ground 2 - Mortgage lender needs possession

The dwelling is subject to a mortgage granted before the tenancy and the lender is entitled to exercise a power of sale and requires possession to dispose of the dwelling with vacant possession. Prior notice was given (or the court dispenses with it).

6. Ground 3 - Former holiday let

The tenancy is for a fixed term of not more than 8 months and, within the 12 months before it began, the dwelling was occupied as a holiday let. Prior notice of this ground was given.

7. Ground 4 - Student let by educational institution

The tenancy is for a fixed term of not more than 12 months and, within the 12 months before it began, the dwelling was let by a specified educational institution to students. Prior notice of this ground was given.

8. Ground 5 - Property for a minister of religion

The dwelling is held for use as a residence for a minister of religion from which to perform their duties and is now required for that purpose. Prior notice of this ground was given.

9. Ground 6 - Demolition or major works

The landlord intends to demolish or reconstruct the whole or a substantial part of the dwelling, or carry out substantial works, and cannot reasonably do so with the tenant in occupation. This ground is subject to statutory conditions about how the landlord acquired the property.

10. Ground 7 - Death of the tenant

The former tenant has died and the periodic tenancy passed under their will or intestacy. Proceedings are begun within 12 months of the death (or of the court becoming aware of it).

11. Ground 7A - Serious anti-social behaviour

The tenant, a member of their household or a visitor has been convicted of a serious offence, breached a relevant injunction or order, or the dwelling has been closed under a closure order, in the circumstances specified by this mandatory ground.

12. Ground 7B - No right to rent (immigration status)

The Secretary of State has notified the landlord that the tenant (or an occupier) is disqualified from renting because of their immigration status.

13. Ground 8 - Serious rent arrears

Both when this notice is served and at the date of the hearing, at least 2 months' rent is unpaid (where rent is payable monthly), or the equivalent for other rental periods. This is a mandatory ground: if proved, the court must order possession.

14. Ground 9 - Suitable alternative accommodation

Suitable alternative accommodation is available for the tenant, or will be when the possession order takes effect.

15. Ground 10 - Rent arrears

Some rent lawfully due from the tenant is unpaid when this notice is served and was in arrears when proceedings begin.

16. Ground 11 - Persistent late payment

Whether or not rent is in arrears when proceedings begin, the tenant has persistently delayed paying rent that has become lawfully due.

17. Ground 12 - Breach of tenancy obligation

An obligation of the tenancy (other than the obligation to pay rent) has been broken or not performed.

18. Ground 13 - Deterioration of the property

The condition of the dwelling or the common parts has deteriorated because of acts of waste, neglect or default by the tenant or a person living with them.

19. Ground 14 - Nuisance, annoyance or illegal use

The tenant, a person living in or visiting the dwelling has caused or is likely to cause nuisance or annoyance to a person nearby or engaged in the locality in criminal or immoral conduct, or has been convicted of using the dwelling for unlawful purposes or of an indictable offence in the locality.

20. Ground 14A - Domestic violence (social landlords)

The dwelling was occupied by a couple, one or both were the tenant, one partner has left because of violence or threats by the other towards them or a family member, and is unlikely to return. This ground is only available to certain social landlords.

21. Ground 15 - Deterioration of furniture

The condition of furniture provided under the tenancy has deteriorated because of ill-treatment by the tenant or a person living with them.

22. Ground 16 - Former employee

The dwelling was let to the tenant in consequence of their employment by the landlord and that employment has ended.

23. Ground 17 - Tenancy obtained by false statement

The landlord was induced to grant the tenancy by a false statement made knowingly or recklessly by the tenant or a person acting at the tenant's instigation.
